Experience
Alex Fernandez is a litigator who represents commercial insurance carriers in complex litigation, arbitration, and claim disputes following catastrophic events. Her practice encompasses first-party matters, including builder’s risk and business interruption claims, and third-party matters, including CGL, professional malpractice, and pollution liability claims. She also has extensive subrogation and bad faith litigation experience.
Before representing insurance carriers, Alex represented companies and entrepreneurs in the energy, retail and financial services industries in litigation involving contract disputes, environmental regulations, business torts, and civil securities claims.
Alex has a track record for obtaining favorable results for her clients both at trial and on appeal. She is committed to solving her clients’ problems as efficiently as possible and believes success starts with mastering the facts in order to learn the “story” of each case. Knowing the “story” leads to effective discovery, negotiating, and, when necessary, trial strategies that connect with judges and juries.
Originally from Texas, Alex stays up-to-date on insurance law developments in her home state, and has been rated a “Rising Star” in Super Lawyers magazine by her peers in Texas and California.
Lead trial counsel for defendant insurance company in suit brought by insured plaintiff in Galveston County, Texas for breach of contract and violations of the Texas Insurance Code resulting in unanimous jury verdict in insurance company’s favor and take-nothing judgment against plaintiff insured. (Prior to joining Robins Kaplan LLP)
Negotiated dismissal of lawsuit filed by insured against client insurance company after filing cross-complaint against third-party based on proactive discovery of third-party’s role in dispute. (Prior to joining Robins Kaplan LLP)
Represented oil and gas operating company in recovering damages after facilities were destroyed in a catastrophic loss. Obtained judgment awarding client over $30 million in damages and attorneys’ fees and denying all relief requested by the opposing party at five-week jury trial in federal court. Subsequently represented client in appeal affirming district court’s favorable judgment. (Prior to joining Robins Kaplan LLP)
Represented multinational oil field service corporation as part of trial team successfully defending liability in connection with all civil litigation and federal investigations concerning well blowout in the Gulf of Mexico. (Prior to joining Robins Kaplan LLP)
Represented receivership of company at a four-week jury trial involving breach of fiduciary duty and professional negligence claims resulting in a multi-million dollar verdict in favor of client. (Prior to joining Robins Kaplan LLP)
Represented defendant officer of publicly traded company in suit alleging securities law violations and breach of fiduciary duty resulting in dismissal of claims against client. (Prior to joining Robins Kaplan LLP)
